All DEVOI clothing is designed in Melbourne, Australia.
- Use of this site
1.1 You must only use the site in accordance with these terms and conditions and any applicable law.
1.2 To place orders and access some of the features on the site, you must register an account with us. To register an account, you must:
(a) provide accurate and current information; and
(b) be at least 18 years old and have the capacity to enter into a legally binding agreement with us.
1.3 This site and its contents are subject to intellectual property rights which are either owned by or licensed to Herde Pty Ltd.
1.4 You must not reproduce, transmit, communicate, adapt, distribute, sell, modify or publish or otherwise use any of the material on this site without prior written consent.
1.5 Some products may differ to a small extent from the way they appear on the site and may not be an exact representation of the products received.
2.1 A contract for the purchase of the goods will not be formed until you receive a delivery confirmation email from us.
2.2 We may in our discretion refuse to accept an order from you for any reason, including but not limited to unavailability of stock in which case we may offer you an alternative product or refund any payment already made by you.
- SHIPPING & DELIVERY
3.1 All international orders are delivered by International Australia Post - Economy Air.
3.2 We are not liable for any losses, liabilities, costs, damages, charges or expenses arising out of delivery/transit. We do not provide insurance.
3.3 Orders will be shipped during normal business hours Monday to Friday.
3.4 Should you require your order urgently, please contact us via email email@example.com prior to placing an order.
- CUSTOMS, CHARGES AND DUTIES
4.1 We are not responsible for and will not reimburse any customs, charges or duties.
- FAULTY PRODUCTS
7.1 If you have received a product with a defect or fault, please contact us via firstname.lastname@example.org as soon as possible with images of the defect or fault so that we may resolve the issue.
7.2 If the product is determined to have a defect or fault, we will replace the product or refund upon receipt of documentary evidence of the amount paid by you. If it is determined that the product does not to have a defect or fault, we will contact you to ship the product back to you.
7.3 The product does not have a defect or fault, if following the sale of the product to you and in our reasonable opinion, the product has become of unacceptable quality due to:
- wear and tear;
- failure to use or wash in accordance with manufacturers’ care instructions; or
- failure to take reasonable care.
- CHANGE OF MIND RETURNS
6.1 You can return any product* within seven (7) days of purchase or the date of delivery for online orders, and if:
(a) the returned product is in the original packaging and is unworn and unused and unwashed with all the original tags still attached; and
(b) returned with documentary evidence of the amount paid by you we will, at your request:
(c) offer to exchange (when stock is available); and/or
(d) provide you with a credit note valid for 12 months from the date of issue.
*We may run sales throughout the year that are final, with no returns accepted. This will be specified in all event marketing when applicable.
6.2 We will not refund any delivery fees, customs, charges or duties that you have paid and you are responsible for the cost of return shipping. We will withhold the shipping costs from the credit note.
6.3 If the returned product is, in our reasonable opinion, not in compliance with clause 6.1, we will contact you to ship the product back to you.
6.4 We are not liable for the loss or damage of the item being returned.
- VOUCHERS, GIFT CARDS AND STORE CREDIT
7.1 We assume no liability for the loss, theft or illegibility of vouchers, gift cards or store credits.
7.2 Vouchers, gift cards and store credits cannot be redeemed for cash and are valid for 12 months.
7.3 If you place an order for a product less than the value of a voucher, gift card or store credit, no refund or residual credit will be returned to you.
7.3 If the voucher, gift card or store credit is insufficient for the order you wish to make, you may make up the difference through payment by other means (but not by using another voucher, gift card or store credit or attempting to rely on any other offer). Only one voucher can be used per order.7.4 If an order made using a voucher, gift card or store credit is returned, the portion of the purchase attributable to the voucher, gift card or store credit will be restored to your account only.
